1. Who We Are and What This Policy Covers

Smiley Aesthetics (“Smiley Aesthetics,” “we,” “us,” or “our”) operates medical aesthetics locations and the website www.smileyaesthetics.com (the “Site”). This Privacy Policy explains what personal information we collect through the Site, how we use and share it, and the choices and rights you have.

This Policy covers the Site and our online marketing only. It does not cover protected health information (“PHI”) that we create or receive as a healthcare provider — for example, your treatment records, photos taken for clinical purposes, and information in our electronic medical record system. PHI is governed by our separate Notice of Privacy Practices, available at each location and on the Site. If there is a conflict between this Policy and the Notice of Privacy Practices with respect to PHI, the Notice of Privacy Practices controls.

2. Information We Collect

Information you give us

  • Booking and contact forms: name, email address, phone number, preferred location, requested service, appointment date and time, and anything you type into a message field.
  • Marketing sign-ups: email address and/or mobile number when you join our email list or text (SMS) program, plus your communication preferences.
  • Purchases, memberships, and gift cards: billing name, billing address, and payment card details. Payments are processed by our third-party payment processor; we do not store full card numbers on the Site.
  • Promotions and reviews: information you provide if you enter a giveaway, leave a review, or contact us on social media.

Information collected automatically

When you visit the Site, we and our service providers automatically collect device and usage information using cookies, pixels, and similar technologies. This includes IP address, device and browser type, pages viewed, links clicked, approximate location (city/state), and referring website. See Section 4 for details and choices.

3. How We Use Your Information

  • Schedule, confirm, and remind you about appointments and consultations
  • Process payments, memberships, packages, and gift card orders
  • Respond to your questions and requests
  • Send marketing emails and text messages, if you have opted in (see Section 5)
  • Run, measure, and improve our advertising and the Site itself
  • Detect and prevent fraud, abuse, and security incidents
  • Comply with legal obligations and enforce our terms

4. Cookies, Analytics, and Advertising

We use analytics tools (such as Google Analytics) to understand how visitors use the Site, and advertising pixels (such as the Meta Pixel) to measure and improve our ads on platforms like Facebook, Instagram, and Google. These tools may collect identifiers and browsing activity and may be used by the platforms to show you ads for our services on other websites and apps (“targeted advertising”).

Your choices:

  • Use the cookie banner or settings on the Site, where available, to decline non-essential cookies
  • Adjust your ad preferences within your Google, Facebook, and Instagram account settings
  • Use browser controls or industry opt-outs such as the Digital Advertising Alliance (optout.aboutads.info)
  • We honor opt-out preference signals (such as Global Privacy Control) where required by applicable state law

We configure our advertising tools so that they are not used on pages where patients log in or submit health information, and we do not intentionally share treatment details with advertising platforms.

5. Text (SMS) and Email Marketing

If you opt in to our SMS program, we will send appointment-related and/or promotional text messages to the number you provide. Message frequency varies; message and data rates may apply. Reply STOP to cancel at any time and HELP for help. Consent to receive marketing texts is not a condition of purchasing any goods or services.

No mobile information will be shared with third parties or affiliates for their own marketing or promotional purposes. Text messaging opt-in data and consent will not be sold or shared with any third party.

You can unsubscribe from marketing emails at any time using the link at the bottom of any email. We may still send you transactional messages (such as appointment confirmations and receipts) after you unsubscribe from marketing.

6. How We Share Information

We do not sell your personal information for money. We share personal information only as follows:

  • Service providers: companies that help us run the business, such as our scheduling and practice-management platform (Aesthetic Record), payment processors, email and SMS providers, website host, and analytics providers. They may use your information only to provide services to us.
  • Advertising partners: as described in Section 4, advertising platforms may collect information through cookies and pixels on the Site. Some state laws treat this as “sharing” for targeted advertising, and you may opt out as described in Sections 4 and 8.
  • Legal and safety: to comply with law, respond to lawful requests, or protect the rights, safety, and property of Smiley Aesthetics, our patients, or others.
  • Business transfers: in connection with a merger, acquisition, financing, or sale of all or part of our business.

7. Health Information

Please do not submit detailed medical information through general website forms. Health information you provide to us as a patient — during a consultation, through our patient portal, or in our electronic medical record system — is protected health information governed by HIPAA and our Notice of Privacy Practices, not this Policy.

8. Your State Privacy Rights

Depending on where you live, state law (including laws in Tennessee, Texas, Virginia, Colorado, Connecticut, and a growing number of other states) may give you some or all of the following rights with respect to personal information covered by this Policy:

  • To confirm whether we process your personal information and to access a copy of it
  • To correct inaccurate personal information
  • To delete personal information you provided or that we obtained about you
  • To obtain a portable copy of your personal information
  • To opt out of targeted advertising, the sale of personal information, and certain profiling

As a courtesy, we extend these request rights to all U.S. residents regardless of state, except where information is exempt (for example, PHI governed by HIPAA, which is handled under our Notice of Privacy Practices instead).

We will not discriminate against you for exercising your rights. If we decline a request, you may appeal by replying to our decision, and we will respond as required by your state’s law.

9. Data Security and Retention

We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, and vetted service providers. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. We keep personal information for as long as needed for the purposes described in this Policy, to comply with legal and recordkeeping obligations, and to resolve disputes.

10. Children’s Privacy

The Site and our services are not directed to children under 18, and we do not knowingly collect personal information online from children under 13. If you believe a child has provided us personal information, contact us and we will delete it.

11. Third-Party Links

The Site may link to third-party websites and social media platforms. Their privacy practices are governed by their own policies, which we encourage you to review.

12. Changes to This Policy

We may update this Policy from time to time. We will post the updated version on the Site with a new “Last Updated” date, and material changes will be highlighted or otherwise communicated where required by law.
